The Republican Public Association «Kazakhstan Authors’ Society» provides the following information on the activities of KazAK for 2019.

1. There are no changes to the Charter and other constituent documents of the Republican Public Association «Kazakhstan Authors’ Society» registered in 2019 by the Department of Registration Service and Organization of Legal Services of the Ministry of Justice of the Republic of Kazakhstan.

2. During 2019, the following bilateral agreement was concluded with foreign organizations managing similar rights:

1) Bilateral agreement dated October 04, 2019 with the National Association for the Protection of Intellectual Property (ANPCI) on the mutual representation of the interests of performers in the contracting territory of the Republic of Moldova and the Republic of Kazakhstan. Also in 2019, the following agreements were signed with foreign organizations managing similar rights: 1) Agreement on unilateral representation of interests in the field of «Big» rights with the All-Russian public organization «Russian Authors’ Society» / Russian Federation, Moscow / dated June 06, 2019.

2) Agreement No. 3-KAO-EAKOP/2019 on granting the right to use software with the International Association for the Collective Management of Rights «Eurasian Confederation of Rightholder Societies» /RF, Moscow/ dated August 15, 2019.

3. During 2019, the general meeting of members of the Republican public association «Kazakhstan Authors’ Society» was convened twice:

1) March 27, 2019, at which the following decisions were made: -introduction of amendments and additions to the Articles of Association — according to the minutes of the general meeting; — Election of the Chairman of the Republican Public Association «Kazakhstan Authors’ Society» — Kydyrbek Balnur Balgabekkyzy; — Elections of the Authors’ Council of the Republican Public Association «Kazakhstan Authors’ Society»; — Elections of the Audit Commission of the Republican Public Association «Kazakhstan Authors’ Society».

2) December 26, 2019, at which the following decisions were made:

   1) Change of the legal address of RPA «Kazakhstan Authors’ Society»;

   2) Election of the Authors’ Council of the NGO «Kazakhstan Authors’ Society» in the amount of 19 people and 2 people in case of replacement;

   3) Election of the chairman of the NGO «Kazakhstan Authors’ Society»;

   4) Approval of amendments and additions to the Charter of the NGO «Kazakhstan Authors’ Society»;

   5) Election of the Audit Commission consisting of 3 people;

   6) Change in the composition of the founders;

   7) Expansion of the Company’s activities in the regions, opening and accounting registration of regional (regional and city — Nur-Sultan, Shymkent) branches;

4. The annual financial statements of the RPA «Kazakhstan Authors’ Society» for 2019 are attached.

5. Persons authorized to represent the Republican public association «Kazakhstan Authors’ Society»:

   1. Kydyrbek Balnur Balgabekkyzy — Chairman;

   2. Yesenaliev Baigali Makulbekovich — General Director;

   3. Adileva Maryash Alumtaevna — Chief Accountant.

6. The total amount of the collected remuneration for the use of phonograms published for commercial purposes in 2019 amounted to 521,315 (five hundred twenty one thousand three hundred fifteen) thousand tenge, including VAT 16,756,000 (sixteen million seven hundred fifty-six) tenge.

7. For 2019, Kazakh performers, producers of phonograms, right holders were charged 33,672,000 (thirty-three million six hundred and seventy-two) tenge, of which 30,305,000 (thirty million three hundred and five thousand) tenge were paid.

8. Data on foreign organizations managing similar rights, on unpaid remuneration, on amounts prepared for payment, were not provided by the relevant services, because due to the lawsuit, the previous management of KazAK did not provide the necessary data; Kazakh performers, producers of phonograms, right holders, the amounts prepared for payment, are also unknown. Undistributed remuneration for 2019 is also not possible to calculate.

9. The actual expenses of KazAC for 2019 amounted to 81,556 (eighty one thousand five hundred fifty six) thousand tenge.
