In 2009, the continued crisis in the country's economy, which greatly affected the payers of royalties, particularly made downhill the small and medium businesses. The number of canceled license contracts with cafes, restaurants significantly increased that year due to their bankruptcy.
For example in 2009, 51 license agreements with cafes, restaurants and mallcentres were terminated.
The same situation is observed in the activities of cable retransmission, where 2 license agreements with cable operators were terminated. But there are 2 new cable operators, which have signed license agreements.
As a result of lengthy negotiations and clarifications, KazAK was also able to enter into license agreements with 84 new cafes, restaurants.
And also it established a new collaboration with the Authors societies like KOMCA, TEOSTO, ONDA, MCSC, SPA and AKM. Thus, protection of Kazakh repertoire now provided in these countries.
The Authors' Council was held in April 15th, 2009 where members of the Audit Commission also participated. The Council discussed the results of the Society for the year 2008 and approved the two regulations:
- "Instructions for the regulation of duties of the Chairman of the Authors’ Council and of the chairperson of the Direction.
- "Rates of remunerations for the reproduction and distribution of published works.
At the Council’s meeting in 7 October 2009 Authors, the current issues were reviewed, where also "Rates of remunerations for the use of published works of music on the Internet” were approved.
An extraordinary general Meeting was held in November 11th, 2009. The issue of accreditation of KazAK at the Ministry of Justice of Kazakhstan in accordance with the article 46-1 of the Copyright Law was the main agenda of the Meeting. By the decision of the Authors’ Council on 15 April 2009 also were approved: "Instruction on the regulation duties of the chairman of the Authors’ Council and of the chairperson of the Direction", "Rates of remunerations for the reproduction and distribution of published works”, as well " Rates of remunerations for the use of published works of music the Internet" on October 7th, 2009.
2010 was not an easy year for our Society in comparison with prior years. It was caused because of world crisis and appearance in the market two more competitive CMO in the field of author’s rights, who received in the authorized state body certificates on accreditation, although it is against the world practice. To win the competition they decreased rates of author’s remuneration below than fixed by the Government of the Republic of Kazakhstan minimal rates and enticed users of KazAK. Due to good organized and professional work of the staff, KazAK maintained all its positions on the prior level in spite of flight of some users to our competitors.
Another difficulty arose because of misunderstanding by user objects of authors’ rights, the point of the introduced changes into the Law of the Republic of Kazakhstan “On authors and neighboring rights”. Some cable operators learnt, that henceforth blanket license can be issued by all CMO, which received an accreditation certificate by Ministry of Justice, refused to pay prescribed royalties from September 2009, although they broadcasted exactly those channels of the countries, whose interests are presented by KazAK according to bilateral agreements. Consequently to the above said reasons collection of royalties, ensured a profit during the last ten years, decreased in 2010 about 9% in comparison with 2009, and in comparison with 2008 about 18%.
At the same time there were occurred also positive tendencies. This year quantity of users signed license agreements increased about: 138 amusement entertainments, 9 cable TVs, 2 broadcasters, 4 mobile telephone providers, 2 hire points, 4 publishing houses, 17 recording studios, 20 show business organizations. Totally 224 license agreements were signed. So the total number of licenses signed between KazAK and amusement entertainments reached to 663, as for the total number of users of all categories increased by 2112.
19 civil claims were filed by lawyers and 17 them were found for the plaintiff of KazAK. More than 10 mln. Tenge compensations and debts were recovered.
86 new authors, who were searched for, were found, thus total number of authors who have authors who have assigned their exclusive rights to KazAK for management on a collective base achieved 1540 according to data as of January 1, 2011.
It was pleasant when we passed an accreditation at the Committee on intellectual property on 16 th of April 2011.
One more achievement of KazAK is purchase of CoSIS program for processing of documents and distribution from SUISA, which maintain transparency of our activity. Mr. Richard Hauser, leading authority in this field was invited from Switzerland to train our staff to use this program. At the present time KazAK maintains this program and all documents and statements processes using CoSIS.
We would like to note that KazAK has entered all members and more than 40000 works into CoSIS. At the same time KazAK enters all its members and their works to world DB systems like WID and IPI.
2012 although it was also difficult as the last 3 years, but there has been some rise. This is evidenced by total volume of the collection (see tables). Despite
the efforts of three parallel organizations offering dumping rates almost all users have contracts with KAZAK became aware of this problem and continue to
cooperate with us. This year we signed 337 new agreements: including 199 entertainment establishments, 3 cable TV, 8 publishers, 3 circus organizations, 3 cinemas,
9 cultural houses, 2 providers of cellular phones etc. So the total number of users reached 2309. This year 104 authors and successors who were searched for,
were found, 90 new authors were affiliated to KazAK thus total number of our members achieved 1882. For 2012, the legal service filed 34 claims of which 18 won
and recovered around 30 billion tenge in compensation and debt. Two foreign societies have signed bilateral agreements on reciprocal representation of authors’
interests with KazAK: Azerbaijan Athors Society and ACUM (Israel).
We consider one of the achievements of KaAK for the past year is adoption of CoSIS program which was introduced in practice from 2011 that provided us
perform to a certain extent requirements of Binding Resolutions of CISAC. This is evidenced by the message of Mr. Mitko Chatalbashev who carried out the
inspection of the activity of KazAK regarding compliance with the international requirements.
2013 marked the 15th anniversary of KazAK foundation. In the second decade, it is worthwhile to narrate about its existence full of various events. There are several societies
active in this area, this negatively affects the royalties of the authors who entrusted their rights to KazAK. At this tough time for KazAK, we would like to express our gratitude
to the authors who gave us the spiritual support and stayed with our society, they did not cooperate with rival societies and users offering dumping prices and respect the Kazak
On 10 October 2013, at the KazAK general meeting, while we presented dozens of heads of organizations with certificates of appreciation, we expressed them our warm gratitude and
mentioned this issue. We extremely grateful to the authors who contribute to the development of the first author society in our country. These authors were honoured at our
reporting meeting held once in five years. Namely, V. Pitertsev and G. Daukenova were recognized as “Awardees of KazAK”. They received letters of gratitude and substantial
financial bonuses. The letters of gratitude and substantial financial bonuses were also given to the employees of the head-office and district representatives.
Despite the difficulties of the previous years, 2013 enjoyed “new development impulse”. The amount of collected royalties reached the level of 2008. We concluded 347 agreements,
including 203 with entertainment organizations, 4 with cinemas, 8 with publishing houses, 4 with internet providers, 53 with organizers of concert and show programmes, etc.
At present, 2,000 authors have agreements with our society. In this year, the number of the new KazAK’s authors has reached 220, among them 122 have been previously non-identified
authors, 98 new authors have become members of KazAK. Now, more than 2,000 authors assigned us their rights.
According to the final report for 2012, KazAK had reciprocal representation agreements with 124 countries, and in 2013 this number reached 131 countries.
In 2011, we purchased COSIS Programme and started its implementation despite the difficulties in the copyright area. Implementation of this programme for internationally acting
KazAK helped to automate the work previously carried out manually. The practice shows that KazAK is in line with SICAC’s “Binding Resolution” and this is very useful and correct
development. Upon introduction of technical innovations in our practice, COSIS Programme helps to assimilate milestone opportunities which substantially help our society.
Despite some difficulties in comparison with previous years, 2014 in general was successful for KazAK. It is very important that the competent bodies decreased the number of
unreasonable inspections. Therefore, the right-holders have now the possibility to receive their royalties on time.
Respect of the international practice, laws of the Republic of Kazakhstan and improve of the professional level of KazAK is the imperative of the present time. On 26 September 2014,
in Istanbul, ВІЕМ and CISAC organized the international conference re: mechanical rights. More than 30 representatives of CMOs from Eastern and Western Europe, and CIS took part in
this conference and studied the latest developments in this area. This was the reason of participation of KazAK in this conference.
On 21-22 July 2014, upon the CISAC’s initiative, the officers of Kyrgyzpatent visited KazAK to share the experience in distribution of the royalties on the CoSIS programme basis.
This demonstrates the high professional level of KazAK on the territory of Eurasia.
At the invitation of Tajik State Copyright Agency, from 11 to 13 November 2014, in Dushanbe, the representatives of KazAK took part in the international conference organized by WIPO
and CISAC re: Copyright and Collective Management of Rights. The conference aimed to present the advance experience of RAO and KazAK for such agencies as Tajik State Copyright
Agency, which still cannot establish independent author societies. Following the report of S. Issayev (Deputy Director of KazAK), Mitko Chatalbashev (CISAC Director for Eastern and
Central Europe) highlighted the success of KazAK achieved over a very short period and noted that KazAK ranked 20th among 400 CMOs of Central Asia and Europe.
In 2014, KazAK entered direct bilateral agreements with BUMA/STEMRA (Netherlands) and UCMR-ADA (Romania). As the results of the above agreements, the international ties of KazAK
cover now 9 more countries (Netherlands, Surinam, Curacao, Saint Maarten, Bonaire, Saint Eustatius, Saba, Aruba and Romania). At the end of 2013, the bilateral agreements of KazAK
covered 131 countries, while in 2014 this figure approached to 140 countries.
During the previous year, the KazAK officers actively searched authors and their successors, as the result, KazAK made 316 agreements with new authors and their successors, 244 of
them were in the search list. At present, the number of the national authors who assigned their rights to KazAK has increased to 2,638 persons.
On the eve of the First President of Kazakhstan Day, some prominent persons of literature and art joined Nurotan political party. B. Yessenaliev (General Director of KazAK), and
the KazAK members – Sh. Abiltayev (composer) and T. Tashenov (poet), ceremoniously received membership cards of Nurotan political party.
On 5 November 2014, the International Turkic Culture Organisation (TURKSOY) named after Toktogul Satylganov decorated KazAK’s Chairman Maral Yskakbai for his contribution to
strengthening the literature and cultural ties of Turkic nations.
